Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and MyShop Enterprises Pty Ltd ("Company", "we", "us", "our") regarding your use of the CafeWallet mobile application and website (collectively, the "Service").

By creating an account or using CafeWallet, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. Description of Service

CafeWallet is a prepaid digital wallet service that allows you to:

  • Load funds onto a digital wallet using a credit or debit card
  • Make payments at participating cafes
  • Purchase, send, and redeem digital gift cards
  • Earn and redeem loyalty rewards at participating cafes
  • View transaction history and manage your account

3. Account Registration

To use CafeWallet, you must create an account by providing accurate and complete information. You are responsible for:

  • Maintaining the confidentiality of your account credentials and PIN
  • All activities that occur under your account
  • Notifying us immediately of any unauthorised use

You must be at least 16 years old to create an account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Wallet Terms

4.1 Loading Funds

You may load funds to your CafeWallet using a valid credit or debit card. All payments are processed by Stripe and are subject to their terms of service. Minimum and maximum load amounts may apply.

4.2 Wallet Balance

Your wallet balance represents a prepaid credit that can be used at participating cafes. Wallet balances:

  • Do not earn interest
  • Are not insured by any government deposit insurance scheme
  • Cannot be transferred to other users (except via gift cards)
  • Do not expire while your account remains active

4.3 Refunds

Wallet balances are generally non-refundable. However, you may request a refund of your remaining balance by contacting us. We may charge a reasonable administrative fee for processing refunds. Australian Consumer Law rights are not affected.

5. Gift Cards

Gift cards purchased through CafeWallet:

  • Are redeemable only at the specified participating cafe
  • Cannot be exchanged for cash (except as required by law)
  • Do not expire under Australian Consumer Law
  • Are non-refundable once purchased
  • May be subject to minimum and maximum purchase amounts

Lost or stolen gift cards cannot be replaced. Please treat gift card codes as cash.

6. Loyalty Rewards

Participating cafes may offer loyalty programs through CafeWallet. Loyalty programs are operated by individual cafes and may have their own terms and conditions. We are not responsible for:

  • Changes to loyalty program terms by participating cafes
  • Expiration or forfeiture of loyalty points or stamps
  • Availability of reward items

7. Payments and Transactions

When you make a payment using CafeWallet:

  • The transaction amount will be deducted from your wallet balance
  • You will receive a digital receipt
  • Transactions are final and cannot be reversed through CafeWallet
  • Disputes about goods or services must be resolved directly with the cafe

We are not responsible for the quality, safety, or delivery of goods or services purchased at participating cafes.

8. Prohibited Activities

You agree not to:

  • Use the Service for any illegal purpose
  • Attempt to gain unauthorised access to our systems
  • Use the Service to launder money or fund illegal activities
  • Create multiple accounts to circumvent limits or restrictions
  • Share your account credentials with others
  • Reverse engineer or attempt to extract source code from the app
  • Use automated systems to access the Service

9. Intellectual Property

The CafeWallet name, logo, and all related content are owned by MyShop Enterprises Pty Ltd. You may not use our trademarks without prior written consent.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

To the maximum extent permitted by Australian Consumer Law, we disclaim all warranties including implied warranties of merchantability and fitness for a particular purpose.

11. Limitation of Liability

To the maximum extent permitted by law, MyShop Enterprises Pty Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

Our total liability for any claims arising from the Service shall not exceed the amount of funds in your wallet at the time of the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded under Australian Consumer Law.

12. Indemnification

You agree to indemnify and hold harmless MyShop Enterprises Pty Ltd and its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

14. Termination

You may close your account at any time by contacting us. We may suspend or terminate your account if you violate these Terms or for any other reason at our discretion.

Upon termination, you may request a refund of any remaining wallet balance, subject to our refund policy.

15. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales.
